BANGOR – It was a crime that shocked people throughout the area. 3 young people shot dead, and their bodies left in a burning vehicle following drug activity that went bad.
The two men accused of killing the victims have been convicted, but one of them is now seeking a new trial. Hoping for another day in court.
37 year old Randall Daluz and 34 year old Nicholas Sexton were both convicted in the murders of Daniel Borders, Lucas Tuscano and Nicolle Lugdon. They were tried together last may even though they wanted separate trials. The attorney for Daluz argued today that his client deserves a new trial because his race was used against him. Specifically in the closing arguments when the attorney for Sexton claimed it was Daluz who pulled the trigger and that Sexton was forced to take part.
The defense also argued that because Sexton testified in his own defense and because Daluz did not it was also used against him. The Attorney Generals office argues that both men received fair trials and the motion for a new trial should be dismissed.
The judge says he’ll take both arguments under advisement and will issue a ruling in the coming weeks.
Neither Sexton or Daluz have been sentenced and are being held at the Penobscot County Jail.
