It was floating near his unmanned lobster boat about a mile from Vinalhaven.

Lt. Scott McCann says the fisherman pulled the body from the water and brought it to emergency crews in Carver's Harbor where the man was pronounced dead.

Officials say she later discovered that one of the children had a broken leg and the other had a broken arm along with other injuries.

Devine claimed the injuries were caused by their 4 year old brother, but authorities dont believe the child could've caused the injuries.

At last report, Devine was being held on $50 thousand dollars bail.
