VIDEO:Transient in Court -- Charged with Manslaughter

BANGOR - It was over a year ago that a Bangor man was stabbed to death in a fight on first street.  Come this Monday,the transient charged with manslaughter was in court for the first day of his trial.


May 22, 2012, Bangor police respond to 71 First Street.  There, police found 1 male subject with a knife wound.  Taken to EMMC where he was pronounced dead.



The deceased, 38-year-old Andy Smith of Bangor.  Fast forward to today,and 42 year old Jason Trickett now stands trial for manslaughter.



A superior court judge heard opening arguments, Monday -- then prosecutors put 29 year old Sarah Denbow of Bangor took the stand.


Denbow testified Smith was intoxicated, and violent, getting into fist fights with at least 2 individuals that night.


It was amid one of those scuffles that Trickett's knife went into smith.


Trickett's attorneys argue it was self defense, but prosecutors say Trickett never claimed self-defense when speaking to police -- but rather an accident.


Trickett remains at the Penobscot County Jail on 50-thousand dollars bail.


Testimony is expected to last 3 days. This is a bench trial -- meaning no jury.


If convicted of manslaughter, Trickett faces up to 30 years behind bars.
