BELFAST - Todd Gilday, who turned 44 years-old Wednesday, stood before Justice Robert Murray in Waldo County Superior Court Thursday afternoon.
He's charged with intentional or knowing murder in the death of 55 year-old Lynn Arsenault of Garland, and elevated aggravated assault on her son, 22 year-old Matthew Day.
Court records say Day was shot in the arm and stomach area with birdshot.
At last check, he's at Eastern Maine Medical Center tonight, now in good condition.
Officers say upon arrival at 162 Waldo Avenue just after 11 last night, the back deck door was open, the window broken with a fist-sized hole in the glass.
Moving into the kitchen they found Day conscious and lying across Arsenault, who was deceased.
Day was able to answer officers questions and reportedly told them Todd Gilday was the shooter.
A friend inside the house at the time told investigators Gilday kicked in the door, shot Arsenault, and stated he was going to "kill everyone in the [expletive] house".
The state medical examiner says Arsenault died from blood loss after sustaining a gunshot wound to the chest.
Gilday is being held without bail.
A date for his indictment has not been set.
